Forgive me for being confused; do I understand right that the situation now is that if it’s clear in 28 days you/ a judge goes for forcing sale of property as part of divorce/ending your obligations, and you get half of whatever’s raised, (I know that may be half of not a lot if it’s in poor condition) and if he fails to sufficiently clear it, he faces prison for contempt, and you move back in, clear it and stay there? Hi Kim, AFter 28 days the court will meet to reassess the occupation order. I think the point is that at the moment the clutter is stopping evrything. I could not move in with all the clutter; nor can it be sold. If he clears up it will appear that he is serious about a sale, and that may be a more likely outcome. If he doesn’t clear, well the consequences are on him, and presumably I would be granted the occupation of the hosue.
So, I have to alter my evidence a little, as at the moment the mess is my evidence. Without that my case is rather different.
A sale would be financially disastrous quite honestly. In its present state the value has been estimated at about a fifth of its value in a normal state. There would not be much left after the mortgage, so I am really hoping that is not the outcome.

Thanks for clarifying. Ithought that might be the case. Hope things work out in the best way possible. August 1, 2018 at 1:03 pm #111862bluesyjay
ParticipantSame here, hoping things will turn out in the best of ways for you August 18, 2018 at 7:25 am #111863Gawainsgoverness
Just a quick update. The 28 days was up this week, and needless to say the house is not sorted He has done some – although only in the last week. He has now rented yet another storage unit as the one he already had was full, so now is struggling to clear up and work enough to pay for it all. (I really don’t think he quite grasps the concept of decluttering) But, the court case is not until near the end of September, so there is an awful lot of time for things to improve.

ParticipantSo. Is someone going to follow up on this? If he used 1 week out of 4 I am not too worried about him taking advantage of the coming 6 weeks until the court date. Especially if no one will come around to follow up on his work. Hope you took pictures. August 18, 2018 at 5:20 pm #111865Kim2014
Is it wrong of me (as someone with storage) to  laugh at: He has now rented yet another storage unit as the one he already had was full, so now is struggling to clear up and work enough to pay for it all. Hello I’ve not been around for a while as I have been really struggling. The whole situation has made me incredibly anxious and I am almost useless at times as I feel so stressed. There are problems in other areas of my life and the total is too much. I find it particularly stressful that in court a stranger will make the decisions that affect my future, and while I can argue my case, I can not force that decision.
Kim, yes I think you are right to laugh. It is just ridiculous. And CQ, also right, he has not tidied up any more at all that I can see. Court is on Friday, and while he could move some stuff between Sunday when I saw the house and Friday there is no way he could do it all.
I don’t know what will happen on Friday, but I am sure that my ex will be punished for his contempt of court, ie failing to carry out his undertaking to clear the property. Whether that will be prison I don’t know – possibly a fine instead. I find it laughable that having threatened to burn the house down rather than see me in it, he only had to tidy up to get his wish.
I’ll update after Friday, and thank you for supporting me in this awfully drawn-out struggle.

ParticipantSending positive energy your way and all fingers crossed for you on Friday! I know the feeling when your future or major financial situations depend on a third party, that you don’t know and can’t really assess. HATE IT! Friday is almost there and hopefully you will feel better than and refocus your energy! September 19, 2018 at 12:03 pm #111868Kim2014
Unfortunately trouble always loves company, and once it edges it’s way in it does tend to multiply. Lack of control over one’s future is always really difficult to live with, ironically given your situation, for many it’s a reason for hanging on to ‘stuff.’
I’m sorry it’s all so rotten for you. Bad enough to be dealing with divorce and hoarding issues, without having messy belligerent nastiness in the middle of it too.
TBH I’d be surprised if they imprisoned him at this stage. It’s not that they won’t, it’s that when householders specifically are involved, there are usually further attempts to resolve things before they go that far, if only because it costs so much and any smart lawyer should be able to prevent it, unless a judge feels that the solution is to have you do the work in which case they might in order to make it possible for you to freely do so.
I really hope that Friday brings you a better situation, and closer to some sort of end to it all.

I would be surprised if he went to prison too. (Though our daughter felt that her money obsessed dad would rather prison than have to pay a fine  ) And neither of us have solicitors. My paperwork was drawn up by a solicitor who owed me some work, but no one in court.I am not sure if there will be further attempts to resolve things though. It is not just that this has dragged on for a long time already, and the court date is the latest in a series of deadlines that have been missed, but the looming presence of the council, whose injunction is only held off by the ongoing court case. If more time is allowed I suspect they will descend and forcibly clear as they have already rung a few times and I have had o dissuade them from going to the house. So I don’t know.
Trying not to second guess Friday’s outcome – whatever happens there will be some kind of closure, and a weight off my mind.
Thanks for the positive vibes. Please also send them to my washing machine, mobile phone and kitchen scales, which have got caught up in the company-loving trouble Kim mentioned

Wise to not go for second guessing, what will be will be. I was just slightly concerned that you might find the courts more lenient than expected, though from all you’ve said your daughter may well be right that he’ll ignore all attempts to make this less painful and bring a worse case scenario down on himself on ‘principle.’ Sorry everything’s decided to break at the same time, it always seems to go that way.
Fingers firmly crossed for you that Friday does bring closure.

ParticipantHere is a kick for your washer (that usually helps best) a loving pat for your mobile and a pleading look for the kitchen scale. They are sensitive little things one better not weigh them down with too many demands  Friday is almost there. Fingers crossed!September 21, 2018 at 5:13 pm #111872Gawainsgoverness
So, this is my post court update… Throughout this sage my case has been unlucky somehow. If something could wrong or get lost it did. Even my solicitor’s secretary took special care of my file chasing up every stray.
And nothing has changed
Got to court. My case is NOT LISTED. Stood there, for once united with my ex in disbelief.
They did find us a judge pretty quickly, but with no background knowledge of the case he was reluctant to make major life changing decisions. So I have to go back next week
 He did say that my ex had not complied with the undertaking, but he has another week to go at it. (I don’t think that much will change in that time so I am not bothered)
I went to the court feeling pretty zen. I came to the conclusion that whatever happened it was going to END, and that had to be a good thing. Sure, if the ex got his way that would rankle a little, but I have to get over that, and move forward. SO it was incredibly frustrating that today did not resolve anything at all.
On happier matters, I have a new phone. My washer has a new pump, but still does not work – I laughed at your post CQ as I had kicked it optimistically only half an hour before
 I will update again next week when hopefully there will be an END

ParticipantYOU GOTTA BE KIDDING! CAn you imagine the kind of trouble you’d be in if you hadn’t showed up? But the other way round. Oh my. Another week in limbo. So kicking the washer didn’t work? Have you tried yelling at it? and hitting it with both fists repeatedly? They are stubborn little pests. Is it not proberly draining water? Does yours have a little flap up front that you can flip down to get to the pump?? Well, if the guy exchanged the pump he must have checked their, but sometimes if something gets stuck there, they stop pumping out water. -
